What can I do about it to remove my name of his mortgage?

default-avatar
Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
This is a common problem. If your divorce agreement or judgment say what you claim it does, then your remedy is to file a Motion for Contempt and Enforcement of your agreement and judgment, seeking to require him to re-finance the mortgage so as to remove you from it, or to force the sale of the house to satisfy the mortgage.

Is a hand written letter letter releasing ownership legal?

default-avatar
Answered by attorney Charles D. Scott (Unclaimed Profile)
Divorce lawyer at The Law Offices of Charles D. Scott PLLC
She cannot file a simplified dissolution unless you are participating (jointly filling) with her. She would have to file a regular petition for dissolution of marriage. If she has filed a petition for dissolution, she must serve you by process server or sheriff. Once served you have 20 days to file a responsive pleading in which you should deny her allegations, and ask the court to set aside the alleged agreement, and include in your pleading a count for partition of real property. Partition of real property means you want the court to order the property sold and the proceeds divided. The alleged document you signed would be at best a settlement agreement and you should ask that any such settlement agreement be set aside as you signed it under duress (she was going to call the cops) and it is not a fair and reasonable settlement. Such a document does not constitute a deed and a deed is what is needed to transfer ownership in real property.

If I’m married and divorced in another state after 23 years of marriage, how do I enforce continued payment of alimony?

default-avatar
Answered by attorney Robert E McCall (Unclaimed Profile)
Divorce lawyer at Law Office of Robert E. McCall
If you are living in Florida and were awarded alimony from another state you can either file a Motion to Enforce in the original state, or domesticate the out of state Judgment in Florida and have the Florida Judge enforce the Judgment. You probably need an attorney.
