If I have been married for 5 years, is my spouse entitled to my pension?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Generally, in the state, in a divorce a spouse is entitled to the pension benefits accrued during the marriage. They are allocated in what is known as a qualified domestic relations order. Life, and especially divorce, is complicated. I would strongly suggest that you see counsel so that you understand what positions are reasonable to take and the results you can expect.

Alimony/spousal support My friend went through a divorce and they told him that he has to pay alimony to his x-wife for the rest of her life.

Answered by attorney Jodie Lynn Bassichis
Divorce lawyer at Law Offices of Jodie Bassichis, P.A.
Good morning. Yes, if the Former Wife is remarried and/or cohabitation alimony should cease. This is unless there was some other provision to the contrary in their Final Agreement.   You would still need to file a Supplemental Petition to stop all alimony.Although, I would like to review the Final Judgment to verify.   Thank you and stay safe!   Jodie Bassichis, Esquire jbassichislaw@gmail.com (954) 954-963-7300
