If both my ex husband and I are US citizens residing in a different country and get divorced - post baby, can I file for child support in the US?

Kristen Prata Browde
Answered by attorney Kristen Prata Browde (Unclaimed Profile)
Divorce lawyer at Browde Law, P.C.
If you and the child reside in New York for six months or more you can file here and serve wherever. However, seeking enforcement against someone living in Kenya will be more than just difficult.

My wife has filed for divorce, we have three boys , I don''t want to live seperate from them, is it necassary for me to leave the house

Answered by attorney Alfred Joseph Polizzotto
Divorce lawyer at Polizzotto & Polizzotto, LLC
Unless there is a Court order which requires you to leave the residence or it is unsafe for you to reside there, it is not necessary to leave the residence.  Just because your wife has commenced a divorce does not mean you have to leave.  During the pendency of a divorce action, the Court will only order you to leave the residence if you have voluntarily set up an alternative place to live OR if it is improper and unsafe for you and your wife to live together.  This generally means that unless there is violence between you and your wife, you can stay in the residence.  There are circumstances under which spouses have been ordered to vacate the residence during a divorce without violence where there has been severe mental cruelty but those are not common. You should review your circumstance with an experienced matrimonial attorney in your area before undertaking any action such as vacating your residence. - Alfred Polizzotto, III

There must be a slow echo along the internet...     It's possible to handle a divorce on your own, particularly if there are no children or assets to divide. However, there are a lot more documents to file than simply a single form. Think in terms of 10-20 different documents - depending upon what is at issue in your divorce.
