It seems like he is trying to get out of paying alimony to you if the children so not ask for child support.  Child Support cannot be waived.  Even if you do not request child support, and even if you make an agreement that he does not have to pay child support, the children, when they get to be 18 can always go back and get child support for themselves.  I'm not sure what good this clause does, because it seems that he is counting on the children not asking for support when they turn 18, or not wanting contribution to educational expenses.  Its hard to answer without knowing the financial situation between the two of you, who has custody, what the support arrangement is proposed to be, etc.  But if your lawyer says not to sign, its probably a good idea.

Usually it does not.  If one party files first and both parties are filing without another cause of action like adultery or something like that, ten it doesn't matter who is the plaintiff and who is the defendant.
