If you have ever lived in the state of Texas for six months and once you reside in a county of Texas for ninety days then you can file for divorce in Texas in the county of your residence. You may seek temporary orders for support, use of the property, payment of the bills, child custody, visitation and child support along with restraining orders or injunctions. Upon divorce the court will make orders that are in the best interest of the children and divide the community assets and debts in a just and fair manner considering fault in the breakup.

It partly depends on what state is involved, but generally property you owned before marriage or acquired by inheritance is your separate property and, therefore, excluded from division in divorce. However, the value of any appreciation in value during the marriage may be considered marital property and, therefore, subject to rules applied to other marital property in your state. And, whether the property you inherited is still separate may depend on what you have done during the marriage; for example, if you deeded the property to add your husband as an owner, it probably is no longer considered separate property.

How was the vehicle titled? In your name alone, in both your names or in just his name? What other property is involved? In Idaho, you each are entitled to 50% of the community property and 50% of the community debt. You need to work through all of the property and debt to figure out if one owes the other. So, it kind of depends as to whether the car was community property or separate property and how it is titled will give some evidence of that.
