Your question is a little rambling. If you are the biological father, you should go to court and get a court order giving you joint custody. If you are not the biological father, then, unless you have grounds to be the guardian, the mother can make any requirements she wants to let you see her son. She is giving you a gift in that case and you have no say.

Yes, if one party is still married to someone else the marriage is prohibited and therefore void. Strictly speaking it is only "voidable" because you probably need to get a judicial declaration of invalidity to protect yourself. If the purpose of you question is based on wanting to keep the current relationship intact as a marriage, you should simply go and get married again.

My putting your wife's name on the deed, you made a gift of the home to the marriage. You can certainly ask the court to give you credit for the downpayment but the court may deny this request.
