Is he still paying the bills, seeing the kids, etc.? If yes, then it will probably not be considered abandonment. Regardless, you should probably contact an attorney and start the ball rolling for the divorce.

In NJ they are both subject to Equitable Distribution and must be considered as marital property for the period the parties were married. Protection only applies for any time the parties were not married.

Fire your current attorney and hire a better one. Discuss you previous representation with your new counsel, the new attorney might ask to have your fees returned, or that you file a grievance with the Bar Association. As for the case itself, the file with the court should be reviewed to determine what the hang up is.
