There was a murder committed in the house I purchased that was not disclosed to me. Can I sue?

Answered by attorney Stephen Arnold Black
Divorce lawyer at The Law Office of Stephen A. Black
Yes, in California, sellers have a legal duty to disclose if a murder occurred in the house. This was established in the case of Reed v. King (1983). In this case, the court ruled that sellers must disclose facts that materially affect the value or desirability of the property, including non-physical defects like a history of violent crime. The court emphasized that such information is not readily observable by the buyer and is known only to the seller Reed v King,  145 Cal. App. 3d 261 (1983)

Can I still proceed on divorce without an attorney?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Divorce lawyer at Cathy R. Cook, Attorney at Law
You are allowed to proceed without counsel. However, the old saying is generally true, " A person who represents herself has a fool for a client." You have serious issues in your case and would be wise to obtain legal advice.

Can someone kick me out the house if the deed is in my name?

Answered by attorney Rhonda Diane Ellifritz (Unclaimed Profile)
Divorce lawyer at Law Office of Rhonda Ellifritz
Spouses cannot kick each other out without a court order. If you ask the cops to assist you in re-entering, they will likely do so and insist he give you a new key if he has changed the locks.
