I would need the precise details prior to a firm opinion, however, and generally, reimbursement for pain and suffering is not taxable as income. If the settlement amount was not taxable to her, and transferred to you, I would suspect that it is not taxable to you either.

In Arizona there are two classes of property owned by a married couple, community property and sole and Separate property. Community property is property that the couple earns or obtains during the marriage. Each spouse has an undivided one half interest in that property. Sole and separate property is property either owned by a spouse prior to marriage, and to which you have not added the other spouses name (like a car you owned, then added his name to after marriage), or received as a gift or an inheritance during the marriage. What you should do is consult with an experienced family law attorney in your area to review your assets (property) and find out how it might be distributed in a dissolution action.
