When I first started practicing law some 26 years ago, there was the occasional attempt to try to get a judge to grant a divorce without all issues of property division, custody, child support, and alimony being finally resolved. The law in Georgia had changed in just a few years before I started practicing law so that a divorce could not be granted without all issues being resolved. I had a case where the mother had remarried and was trying to deny the father his visitation that their divorce was invalid and that they were still married, because the judge had granted a divorce and attempted to reserve all other issues.

Jurisdiction to file a divorce typically depends on how long you lived in the state and not where you were married. In Georgia you must have lived in the county for six months before you can file for a divorce.

I believe you have to remarry your second husband as your marriage to him is void due to your incapacity to be married when you had not yet divorced. It is actually bigamy-so be nice to your second husband.
