Have an attorney review the texts. You have to really be in fear for your safety. Technically you can get a restraining order but if no safety issues the court may not grant one. Also some counties and judges are quicker to grant them than others.

No. You need to get a restraining order to get him out of the house. You need to prove harassment, threats of violence or actual violence to get an order giving you possession of the family home.

Each State has their own residency requirement to file for a divorce. In California, you need to live in the State for 6 months and the County for 3 months prior to filing a divorce petition. Check in your State. In California you then have a minimum waiting period a six months and a day from when the other spouse was served the Petition.
