Your lawyer will file a Qualified Domestic Relations Order (QDRO) that will get signed by the Judge. Once the QDRO is signed, it will need to go to the retirement Plan. When your husband retires, the Plan administrator will know to send you the share you are entitled to under the QDRO. Good luck!

Yes, they can arrest you. No you can not refuse to go with them. If it happens, get an attorney and DO NOT discuss the issue with the police without that attorney being present.

I am filling for a divorce and NY. I meet the resident requirements but I want to have the summons notarized in Georgia and mail it in. Can I do that.

An out fo state notary should be fine.  However, a New York summons does not require a notary so you do not have an issue with that. If you are taking about the divorce complaint, then again, an out of state notary should work.   This is not legal advice nor does it create an attorney client relationship. It is just informational.
