How can I get full custody of my five year old son?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
Full custody of your child is probably not in his best interests. The court will send the two of you to mediation at which you can try to work out arrangements which will protect the boy and still afford the mother contact with her son.

What can I do to move forward with the divorce?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
If he provided the Schedule and Assets and Debts and the Income and Expense Declaration you could ask the Court to waive FL 141. Both parties can waive FL144 use the form. On that form it states that you've both done the disclosures. If he's not done the disclosures, hire an attorney to do discovery, maybe he's hiding something.

How long after I file my response do I have to mail the certificate of mailing?

default-avatar
Answered by attorney Donald E Oliver (Unclaimed Profile)
Divorce lawyer at Oliver & Duncan
If you are filing a Certificate of Service by Mail to show the court that you did indeed serve the Response on the petitioner, the original certificate should be attached the original response when it is filed with the court. In our office, we usually file our documents by mail and the copy for the other party goes into the mail chute at the same time the original goes to the court.
