What can be done to stop alimony payments upon loosing a job or retiring.

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
In order to stop or adjust alimony payments, it is your burden to prove to the court that there is a significant change in circumstances since the order for alimony was entered. A job loss or reduction in salary more often than not is seen as a "temporary" change and would probably not move the court to stop your alimony. Retirment, however, is a permanent change in circumstances that should trigger the end of alimony.

If I get a divorce after a long term marriage, what are my rights?

It sounds as if you may need an attorney to help you move forward, because it looks as if you got stuck after you filed initial paperwork. You need to make a request for orders of Spousal Support immediately, it will not be half of his income, but it will be a significant help. Next, you need to begin finding out exactly what the marital assets and debts are, where they are held, if any significant amounts have been removed by your husband since the separation date, and prepare a proposal to divide things approximately 50/50. If you can't work it out, you will need to go to trial and have the Judge divide things, but you need court orders, not just private agreements in order for it to be enforceable.

I want to put our house and mortgage in his name he has bad credit and of divorce him

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
I can't really figure out what your question is from the information you have given.  You want to put your house in your husbands name but he has bad credit?  If the mortgage is going to be in his name, he will have to qualify for the mortgage and if his credit is bad, he might not qualify.  The mortgage company must accept him in the same way any one else has to apply and be accepted.  You can't just transfer the property and put it in his name without approval.
