Most likely not unless the 401(k) was omitted from the Judgment. Depending upon the terms of your Judgment you may be able to ask for spousal support though.

If both me and my spouse filed for divorce and I served her first so whose case will take precedence?

Answered by attorney Terry Anne Buchanan (Unclaimed Profile)
Divorce lawyer at Law Office of Terry A. Buchanan
Generally, the action first served would take precedence. The judges overseeing both case will need to communicate to each other to determine whose state would have jurisdiction over this case. More facts necessary for an attorney to respond.

No, you can only be married to one person at a time. Lying about your marriage, either on enter or to marry here has immigration ramifications.
