Hello, I am going through a divorce and need some some advice about finances.

Eric Zev Reimer
Answered by attorney Eric Zev Reimer (Unclaimed Profile)
Divorce lawyer at The Reimer Law Firm, PLLC
Unfortunately for you yes, she can claim it.  Now whether she wins anything is a different story, and it would behoove you to consult an attorney.  Understand that your concepts of ownership (joint bank accounts, sole bank accounts), don't' really concern divorce courts - they are interested in knowing whether and what your "partnership" owned during the marriage.  So whether or not the money went into a joint or individually owned bank account, if you earned money during the marriage, the courts will consider that money that you both have a claim on. I practice in North Jersey, I can't tell where you live, but I'd be happy to arrange a consultation with you to speak with you at greater length about the unique facts of your case. Lots of luck to you. ___Eric Reimer, Esq.Paramus, NJ(877) 885 - 8800ezr@reimerlawfirm.com

I have a house I made my husband sign a prenaupt and I am retired, will I receive alimony based on infidelity?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
If you made your husband sign a prenuptial agreement did you sign one also?  Did you mutally agree that you would not seek alimony?  If you did, then the prenuptial agreement would govern.  however, if the agreement is limited to him not having an interest in your house, then you might be able to get alimony.
