You need to file for divorce and work out the details for a final settlement, including who will get the house. You don't provide enough information to be sure, but it would appear that for now she has as much legal right to live in the house as you do and only a judge, in a divorce case, can break the tie.

You can only wait as long as your husband chooses not to file for divorce. Once he files, you will have to deal with the situation. But, there is nothing he can do to force you to file for the divorce at all. The problem for you, however, is that until someone files for divorce he can pretty much do what he pleases and there is little you can do about it.

First of all, you should meet with a therapist in your community. You need to find the tools to handle the stress better. If you want to divorce him, all you have to do is go file at your local Family courthouse. If you cannot afford an attorney, call your local Legal Aid office to see if they can help you.
