How do I file for divorce if I have no desire to move back just to get divorced?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
You need to file a divorce in Florida, right? That is where you last resided together, right? If not, speak with an attorney where you last resided together. You can file in Florida if that is the right state, and his residency in FL can be used to establish jurisdiction. You moved, so you have not been a continuous resident of FL for 6 months. It is going to be very confusing to you unless you can get a conference with a Florida attorney, perhaps over the phone. I cannot speak for what other attorneys have told you, at all. All I can do is tell you how I see it.

Is my divorce finalized if this is what it says online?

Call the court and give them your new addresses. Or better yet, go there and see if the judgment was formalized in writing and get a copy of that.

Can my husband sue me for abandonment?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
Abandonment requires a showing that you left the children without providing your contact information and no means of support. It is hard to prove unless you have been absent for an extended period of time. It's rare given the kids are with there father too. You should consult with a family law attorney.
