Talk to an attorney, You need to file papers in the Divorce court as soon as possible. There is a limited amount of time to assert fraud or lack of service of process. The case can be reopened, Wife sanctioned.

Seeking a divorce from a Canadian citizen not living in the United States

Answered by attorney Hilary B. Miller
Divorce lawyer at Hilary B. Miller
Generally speaking, you should proceed with a divorce. The fact that you have not lived together is essentially irrelevant and, again, generally, a divorce will be more readily, and less expensively, available. You will need to commence the divorce action in the state where you reside, not where you were married. There is a procedure for serving absent defendants, regardless of where they reside. An attorney can assist you in this process. Get an attorney.

What can I do to speed the divorce up?

You have the right to hire another lawyer if you believe your attorney is not moving the case along. It would be wise to press your current lawyer for help rather than incur the expenses of change lawyers when you are close to completion of the divorce.
