You don't say if what he has to pay you is support or funds that constitute a division of property. If it's support, he can not bankrupt out of it. If it's a division of property that was reduced to judgment, it is treated as a secured priority debt. If he is not currently in bankruptcy, you can go to court on either a motion for contempt (support) or a motion to compel.

In order to file for an uncontested divorce, you need to be able to get your husband to sign a document known as a "Waiver of Citation." Otherwise, you will need to file a divorce petition in your county, attempt to serve him with the paperwork, allow him to answer the divorce petition, and try to come to an agreement about what will happen with the property the two of you acquired during your marriage. Based on the limited facts provided, you do not meet the length of time grounds of 72 hours. You might meet other grounds based on the facts of your case but you can always get a divorce anytime.
