Do you have to pay child support with joint custody in Ga.?

Michael Todd Hampton
Answered by attorney Michael Todd Hampton (Unclaimed Profile)
Divorce lawyer at M. Todd Hampton, P.C.
The short answer is it just depends. You will have to do a child support worksheet to see what the amount for both parties should be. The worksheet may actually show no child support is owed based on your incomes. Most likely, however, if neither party wants child support you will have to agree to a deviation that shows why it's not necessary. If it's uncontested, you can generally reach an agreement for no child support as long as the judge agrees it's in the best interests of the child.

What should I do if I can't get my spouse served and he refuses to sign the waiver?

You have to arrange for the process server to basically be on call, or get a private process server appointed. Speak with your own attorney about this.

What do I do next if i don't agree to counselling?

Answered by attorney Patrick "Leh" Meriwether
Divorce lawyer at Meriwether Tharp, LLC
In Georgia, it only takes one to go forward with the divorce. Georgia is a no-fault state and you do not have to agree to the counseling. If he won't enter into a settlement with you, proceed forward towards a final trial. If you have any questions on how to do this, I would recommend a consultation with a local divorce lawyer just to put you on the right track.
