What can I do if my wife was given the house in our divorce and she is not making payments and its hurting my credit?

Answered by attorney Laurie Weiss (Unclaimed Profile)
Divorce lawyer at Weiss Law, P.C.
Did the paper state that she was responsible for paying the mortgage. If so, you can file a contempt action against her for failure to do so. If it does not state who is responsible for paying the mortgage then you have a big mess and is advise you to meet with a divorce attorney ASAP!

I quick deed my house to my ex wife she re-modified the original loan without me should I be responsible for new loan?

If you signed on the new note, you would be liable. It appears that she managed to modify the loan without you signing on the new loan - probably because she showed the bank that she is divorced from you and that the house was transferred to her alone.

Am I entitled to a pension, if we were not married at the time my husband was in the Armed Forces?

Yes, you are entitled to retirement. Most people believe that you have to be married 10 years with at least 10 of those years the service member having served; however, this rule only applies to DEFS directly paying the spouse and has nothing to do with entitlement. You are entitled to military retirement as a property division no matter what. The question is, how much of a percentage (capped at 50%) are you entitled to?
