How can I protect my 401K during a divorce? Also would it still be protected if I roll it over to an IRA?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
Assets acquired during the marriage (including retirement) are presumed to be community property, and will therefore be equitably divided in the divorce. This is true whether you keep it in 401k or roll it into an IRA.

Yes. Even though you don't explain what you mean by "an outstanding warrant", there isn't anything about any kind of warrant that prevents filing for divorce.

Can I petition the court to have waiting period waived in Colorado?

If you are referring to the 90 period for a final decree, the answer is no. Technically, this a statutory limit on a judge's power - not a waiting period.
