Do I absolutely have to get a divorce or do I have another option?

David M. Rich

Yes, you have to get a divorce. Marrying someone while you still are married to someone else is a crime in Colorado (bigamy). We can help you complete all the forms you will need and get through the process as fast as possible on a reasonable flat fee basis if you would like assistance. We offer a free initial consultation if you would like to discuss your situation further. I hope this helps.

How fast can I get a divorce if my husband and I live in two different states?

David M. Rich
Answered by attorney David M. Rich (Unclaimed Profile)

The fastest you can get divorced in Colorado is 91 days after he is served with the petition for dissolution of marriage. The fact that he is in Georgia does not make a difference. However, to be finished in 91 days will require his cooperation. If he does not cooperate to get his financials filed and sign a separation agreement and couple other steps, it can drag on (generally no more than 6 months though in a case like yours). A lawyer can be helpful in cases like this by knowing the process and keeping the process moving forward to get you done as soon as possible.

Is there a time limit where abandonment and divorce can be filed if the spouse left and what rights do I have if everything is in his name?

See an attorney so that money and assets aren't moved or disappear. As everything's in his name, he can do what he wants unless you stop him. Don't wait to file for divorce.
