How much would he be entitled to if I filed for divorce?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Call my offices or another attorney with the details. Generally you will split what was accumulated during the marriage. As for the truck, I suspect it will go to him with the debt which it secures. You problem will be if he does not make the payments as, even post divorce and if the order states he is to pay the debt, the bank will still be able to come after you.

If my husband refinances our home solely in his name and based solely upon his income and I sign a quit claim deed, am I totally off the hook?

Answered by attorney Jessica M Cotter (Unclaimed Profile)
Divorce lawyer at The Law Firm of Jessica M. Cotter, P.L.L.C.
In Arizona if you have quit claimed the property to him, and the refinance is in his name only, then it would appear that you have been removed from any liability for the mortgage. Arizona has protections built into its real property law that prevent a mortgage company from doing anything but taking the house back, at least for property that is a single family home on less than 2 1/2 acres.

My fiance's ex wife take the truck that my fiance gave to me legally?

Answered by attorney Larry R. Garrett
Divorce lawyer at Holman Cahill Garrett Ives Oliver & Andersen PLLC
She can only take the truck if she goes to the effort to prove the transfer to you was a "fraudulent transfer." This is not an easy thing to show and unlikely in the context you describe. Now, keep in mind if the ex-wife is right that your fiance has not honored his commitment to her, under the divorce, he may still owe her some money.
