How can I protect my 401K during a divorce? Also would it still be protected if I roll it over to an IRA?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
Once a divorce is filed there are standard restraining orders which affect all property including retirement benefits. The 401k - to the extent it was acquired during marriage- will be divided in the divorce by means of a written document called a QDRO. You can transfer your 401k from one account to another so long as it is from "trustee to trustee". Your investment person can explain how to transfer that stuff safely for you.

Can my husband keep my car if it's in my name?

That question cannot be answered without knowing much more about the overall financial situation that will be decided in your divorce. The vehicle will go to whoever the two of you agree should get it; if you can't agree, the judge will have to decide what is fair under all the circumstances and there are no simple rules as to how the judge will make that decision.

Can I get spousal support even if I'm married to my husband for only four years?

Spousal support has two components: temporary and permanent. You will probably not receive it on a permanent basis but, depending on both of your incomes, you could receive temporary spousal support. That support is based on how much income each of you have each month and a consideration of certain of your expenses and tax deductions. I strongly recommend you have at least one consultation with a family law attorney in person to get a better idea of your rights and duties in the divorce. Please do not sign anything until you have talked to an attorney in person.
