What does court require to prove child is not the husband's child?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
The court will require a DNA test of the child and the putative father. You will have to ask for a court order for the testing to be done. The wife will not be able to refuse that. If you want to make sure that you don't pay child support, ask the court to hold off on a final decree until the baby is born and the DNA tests are performed. I suppose it is possible that the court could grant the divorce and keep jurisdiction over the case until the child is born.

Do I have to have an attorney to file a motion even if my ex is ok with the changes I want.

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
You need to file a Suit for Post Divorce Division of Community property. Because your husband agrees to giving you a portion of his pension, it should be relatively simple to get an agreed order for his pension plan. The order you will need to present to the pension plan is called a qualified domestic relations order (QDRO). This is a fairly complex process. Your husband will need to be served and it's effectively like having a second divorce, except this time only as it relates to undivided community property.

I am wanting a divorce for some time, he got deported and I haven't heard from him since, what needs to be done?

Answered by attorney Kevin L. Dixler
Divorce lawyer at Law Office of Kevin L. Dixler
There is nothing stopping you from seeking a divorce other than the ability to hire an attorney and/or pay the filing fees. You ought to seek help from an family/divorce attorney. If you successfully petitioned him, then his deportation likely ended your responsibility for him based upon form I-864.  He can be served at his last known address whether in the U.S. or outside the U.S.  If that does not work, then likely by publication, but you must speak with an attorney licensed in Texas to seek legal advice for that matter.  Good luck. The above is general information, not legal advice, and does not create an attorney client relationship.
