Yes, there is something you can do. You will need to file a Suit for Postdivorce Division of Community Property. This will allow you to bring it to the court's attention (and your former husband's) that you are entitled to his retirement account and the income from the rental properties if they were acquired during your marriage. It is essentially re-doing the property division aspect of your divorce and is the ony way you will get your fair share of the community property acquired during your marriage.

There are more details needed here; however, in Texas if he never revoked his last will & testament in writing by writing another will after their divorce, the will he wrote while married to your friend is still valid. Please advise your friend to consult with a local attorney who is familiar with estate planning.

Your joint account is owned jointly, until a divorce petition is filed with the court, they is no set rules on how to share the money, however once the court steps in, one maybe called to explain how monies jointly owed by the community estate was spent to avoid an assumption of waste or hiding of funds.
