Can I re-file that same case, since we filed without prejudice, or is there a time limit for that?

Without prejudice means that you can file again. If it had been "with prejudice" you can't file again. But, no one can really enforce "with prejudice" in divorce cases because the US Constitution provides that we all have freedom of association rights. To answer your question: You can file again but you cannot use the case number from the prior case. It will be a new case number. Good luck.

If you two own property together or have children together, you will probably need to seek remedies to address those issues in court. However, you may need to get formally divorced in whatever state you were originally married in because there technically is no divorce option available for gays and lesbians in Texas. Speak to a local attorney about the particular circumstances surrounding your marriage to determine what the best course of action is for you to take.

A protective order won't start the divorce. You have to file a petition for divorce. A court will make temporary order to address the property and child support and possibly spousal support while the divorce is pending.
