What does it matter? If each is entitled to their own property and nothing else, then who cares. If you are giving something to your spouse in the event of divorce, I suppose you could make it two-tiered, i.e. you get $10,000 if I file and $5,000 if you file. But since the pre nup should be reviewed by an attorney, ask your attorney to draft it.

Typically, in Florida, permanent alimony is only awarded in long term, greater than 17 year, marriages, and then only if there is a need for same (big difference in incomes between the two parties). You should consult with an attorney who practices in your area if you are potentially looking at a divorce with alimony as an issue.

You can certainly ask you to do just about anything, whether or not he can prevail is a different matter. The divorce court will look at the individual situation and attempt to fashion a fair and reasonable result if you do not agree between yourselves. Please realize, even given the shortness of the marriage, it can be shown that the improvements increase the value of the house during the course of the marriage he will be able to claim half of the appreciation.
