Find out by talking to the supposed ex, ask the clerk of court in your county. If you have never seen the final judgment of dissolution, there may not be one. If you are still married, I suggest you get a divorce.

Yes you can legally divorce him anytime..AS to the baby's name.. let the court decide who has legal custody .. then you can make the decision.
