Get an attorney.. she can only kick you out if she gets a court order.. she might apply for one with those reasons and get it if you do not defend.

If your decree provides that the parents are to share the costs of insurance for the children under certain circumstances and those circumstances have now arisen, and if your ex-husband refuses to comply with the provisions of the decree of divorce, then you can go back to court asking the court to enforce the decree against her ex-husband and to sanction him for his noncompliance.

What should I do if my wife had a child with someone else?

Answered by attorney James T Weiner (Unclaimed Profile)

You can always divorce her.. but alas there is not much else except forgiving her and treating the child as yours. Further, please be warned that Michigan law presumes in the absence of proof that a child born to wedded parents is the child of the both parents.. so you might be responsible for child support for the child that is not yours. That said there is a new law that may allow you to requires you to prove that the child is not yours and you might be able to get out of paying child support for that child. Please consult with an experienced family law/divorce attorney if you choose a divorce this new paternity issue is something you should not even attempt on your own.
