Legality of separation from bed and board

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
What your mother signed was an agreement to be separate from bed and board but from what you said it was not a court order, or a judgement.  I don't think it will have any force or effect, and that on your father's death, your parents would still be considered legally married.  If your father died without a will, she may still be entitled to inherit a portion of his estate.

Can my wife take me to court for child support if the child is not mine?

Does your name appear on the birth certificate? That could complicate matters. If a court enters an order of paternity against the man you believe is the biological father, then that should shield you from an order of support. Unfortunately, there are no absolute guarantees. You should consult with an experienced family law attorney in your area to review this matter.

What is a default divorce in NJ

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
Default will be entered but it is not automatic.  You will either have to ask the court to enter default on the day of the next hearing, or you can  file something with the court before the January 25 deadline and indicate that the informaiton that was supposed to be provided was not and ask for default to be entered.  Serve a copy of this on your husband by certified mail, return receipt requested.
