Can I get spousal support if I have been married for twenty years?

Tajara Dommershausen
Answered by attorney Tajara Dommershausen (Unclaimed Profile)

This is very fact specific. You should get an attorney. Yes you will be eligible to argue for maintenance but how much and for how long are either done by agreement or the court decides the matter.

Do I have to pay alimony if my spouse has been committing adultery?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
California is a "no fault" divorce state. Hubby's adultery is not relevant to whether spousal support should be paid. Spousal support (temporary kind) is based on the relative income of both parties and the ability of each to work. Temporary support is based on additional matters. I strongly suggest you meet with a family law attorney in your county for some assistance with your case.

If your car has a loan on it, you will probably get to keep the car.  It would be unlikely that a judge would award your wife the car but you still have a car loan and payments to which you are obligated. If the car is paid for, you can ask the judge to award it to you and show reasons why.  I think a larger problem than the car is going to be your 5 month old child. You are going to have to address custody, visitation, time sharing, parental responsibility and child support.  These are much bigger and more important than a car with a loan against it.
