Can a Trinidadian file for a divorce in Trinidad although I was married in Texas to a permanent resident there?

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
I only practicei in Texas. No matter where you got married, you can file for divorce in Texas if you meet the residence requirement. You have to live in the state for 6 months and you file in the county you've lived in for 90 days. You would have to ask a lawyer in Trinidad whether you can file there. It's likely that any jurisdiction has a residency and domicile requirement.

Can DES do a DNA test without my knowledge or consent?

Answered by attorney William R. Pelger
Divorce lawyer at Pelger Law
That's a complicated situation. You would have to file support enforcement proceedings against someone you have now remarried and share a home with? You really need to go to the Family Division, see a counselor and look at the file to learn what is actually going on. Or, hire a lawyer to do it for you. As far as the testing, the Family Division can do mouth swabs on a reputed father if paternity is an issue, but the story sounds suspicious to me. Normally, DNA testing is difficult to get retroactively, is generally done only by court order, and is usually initiated by one of the parties, not the Family Division.

Can I revise the divorce to where he only gets to claim my child when he is up to date on support?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
You would have to go back to the court for a modification of the order and the reallocation of the exemptions. The correct answers to take them back to court, have him found in contempt and the support obligation enforced in the same motion where you are seeking modification.
