Ask the court to enter the default judgment if your spouse does not respond. If your spouse does respond, then you have to go to trial if it cannot be resolved.

Talk to an attorney in your state. Once a child is emancipated, he is no longer responsible for child support. However, the agreement should be binding as a contract and he should still be responsible. Your agreement should have stated what kind of post high school education you'd accept.

Will I lose my common law marriage if I move to another state?

Answered by attorney Laurie Peters
Divorce lawyer at Laurie Peters Associates, APLC
California does not recognize common law marriage, UNLESS it was already established in another state. So if you are considered marriage elsewhere, you would be considered married here.
