Can i request alimoney,if my husband abandoned the home and has a live in girlfriend now

Michael Todd Hampton
Answered by attorney Michael Todd Hampton (Unclaimed Profile)
Divorce lawyer at M. Todd Hampton, P.C.
you can always request alimony, and the court will consider all the circumstances such as his income and the conduct of both parties that led to the separation. there is no guarantee you would be entitled to it, but it sounds like you have a good argument. the question will be how much "other income" does he have. if you haven't already, a lawyer will help you file for divorce and request alimony from him. you can schedule a hearing in front of a judge to determine whether he will have to pay.

What am I entitled if I get a divorce?

Answered by attorney Kathryn L. Hudson (Unclaimed Profile)
Divorce lawyer at Law Office of Kathryn L. Hudson
Generally one is entitled to alimony after 10 years of marriage taking into account the education, past earning, potential earning, the health of spouse seeking alimony, and the length of the marriage. After 16 years of marriage as a homemaker you would be entitled to alimony and of course child support should you be the custodial parent. You could also be awarded one-half of your husband's retirement.
