Can I divorce my spouse ASAP without his consent if he's not a citizen?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Divorce lawyer at Graves Law Firm
You can divorce him; it doesn't matter whether he's a citizen. But it takes at least 60 days in Texas unless there's a good reason for the judge to waive the 60-day waiting period, and his being absent or a non-citizen won't get you there. You'll also have to serve him with the divorce petition, personally if you can find him or by publication if you can't.

Is it true that I'll still be held accountable for this car loan even after divorce?

Yes you are responsible. All marital debt is attributable to both parties even if the divorce decree states that the debt was his. Your remedy would be to take him back into court for Contempt of the Divorce Decree. A judge can order him to pay on the loan.

Will I lose my house if I have to move out because my husband becomes abusive?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
If he becomes abusive immediately file a restraining order and ask for a kick out order so he has to leave the house. Never stay in an abusive situation. If he attacks you, call the cops. You can't enjoy a house if you're dead or in hospital. Opinion not legal advice.
