You both have the same rights to the house so either you have to come to an agreement or you have to ask the court (in a motion) to determine who stays until the case is resolved. Ultimately, if you want to keep the house, you'll have to pay his his fair share.

Modifications are generally allowed in custody, support and visitation issues when there is a change of circumstances. There is usually no opportunity to modify a property settlement issue. If the divorce was back in 2009, your right to appeal has also passed. Sorry.

If he throws your things out call the police. That is your home and even if the house was his before you got married, you have an interest in it for payments made on it during the marriage. You might want to file for a restraining order at your local court before he does anything as dramatic as throwing you and your son out of the house. It all sounds very dangerous.
