The answer to your question depends on what state you live in. If you live in Georgia, then a divorce must address an equitable division of marital property. Marital property is generally that property which was acquired during the course of the marriage. Obviously one asset may have a marital portion and a nonmarital portion. Your situation will have to be resolved either by agreement or by trial.

He must file for a divorce.  He may have facts for an annulment, even.  The cost is a typical county is about $250 to file for a divorce, but provided they have no accumulated much in debt or assets, the process should be fairly quick.  He will have to wait 60 days from the date of filing to obtain a final Divorce Order/Decree - as that is Texas law.  He should contact an attorney ASAP.  Many, like myself, offer free consultations to residents in their area.

I live in texas and I sold a home that I purchased before we were married. His name was never added to the deed or mortgage.

In Texas, the house would be considered your separate property upon dissolution of the marriage if you can present proof that you bought it before you got maried (which is sounds like you can). However, because you are still married to him, the title company needs his signature because there has not been a divorce and a judicial determination of title to the house. Thus, there has been no judicial determination of whether he should get proceeds from the sale of the house. Technically, he should not get any proceeds. However, since you are still married, he might make a claim for proceeds. Is he trying to get money from the sale? Will either of you file for divorce?
