With divorce on the horizon, is there a way I can get both kids on child support at once?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
The outcome depends on a lot of facts. It sounds like the child who lives with the mom has the right to child support. You could try to get placement of that child, if circumstances have changed and it is in the child's best interest. Then the support calculation would change. Also as to the present divorce: if you have substantial placement of the child, you get a reduction in the child support you must pay, or in certain circumstances you could be receiving child support for that child. Find a good marital lawyer. Good Luck.

Can she take the truck being so short of a marriage?

Answered by attorney Mark A Manning (Unclaimed Profile)
Divorce lawyer at Mark A. Manning, P.C.
Typically assets required before a divorce are regarded as non-marital assets and are not subject to division in divorce. Now there are exceptions to this rule, however, they are rare and very rare in particularly short term marriages such as yours. For example if she could show you put extensive amounts of joint marital money into the truck she may have some claim.
