You are talking about a Divorce from Bed and Board which takes you through all the legal procedures for a divorce up to the final judgment. But it probably does not apply to you. You can move out and ask the Court to Order him to pay spousal support and child support. You can apply in NJ for a divorce if you are still living with your husband.

Grounds for a New Jersey annulment are: Bigamy, Duress, Nonage, Incapacity, Impotence, Incest, or Fraud. An example of fraud is that one spouse is an immigrant and uses the other spouse to stay in the country. I understand that you need answers and need to protect yourself. I strongly suggest that you schedule a consultation with a family law attorney who has experience with immigration as soon as possible, so that you can understand the implications for you and your spouse.

It sounds like you have not yet decided you want to be divorced, so my advice is going to be to figure out if that's what you want first.  Ask you wife if she will go to counseling only to help you.  If you feel like you are being looked down upon, you need to address that first.  Being a stay at home dad is no different than being a stay at home mom and the divorce will proceed the same way.  Good Luck.
