Can i file for divorce in florida if i got married in new york?

Answered by attorney Nicole Kessler Ferry
Divorce lawyer at Nicole Kessler Ferry, P.A.
If you have lived here for 6 months, you can file for divorce. Since you don't know where he is, you will have to publish the divorce for 4 weeks in  a newspaper that is in the last known address for him. It is called service by publication.  After the publication has ended, the newspaper will give you verification that you would then file with the Court. The Court can enter a default and set a final hearing. This process is in my opinion much harder for an unrepresented party to complete. I highly suggest hiring an attorney to handle for you. Best of Luck.

I consented to a divorce agreement with spousal support that I cannot now afford how may I get it changed?

Divorce lawyer at Law Office of Erin Farley
There are several issues here, and it is wisest to consult with an attorney to understand your options on each issue. As to the MSA, timing is crucial, and affects whether you have options regarding the agreement as a whole. As to spousal support, check whether the agreement calls for modifiable support; if so, then you can file for a modification of the amount. As to the contempt: communicate. "Inability to comply" is a possible defense, but your ex's attorney may be open to negotiating so long as there is a payment of some sort.

Does my wife owe me half of our tax rebate or can that go to child support?

If you filed a joint return then you are entitled to one half of refund. This refund is a property issue and not related to child support.
