Can my future husband claim part of this condo in a divorce?

The answer to your question is yes. Payments made on the mortgage after marriage are a marital investment. So, the interest that the spouse accumulates is one half of the mortgage reduction after the marriage.

Which state is best for filing a divorce proceeding?

Florida, it appears, would be the place to file, but that would depend upon having been a resident here for 6 months, and it would also depend upon which state would have the best laws for you to file in. I can tell you about Florida law, but not about California law.

If I am divorced, how do I remove spouse from my home, if the house wasn’t brought up in the decree?

Robert Joseph Merlin

If she was never on the deed, title is still in her name. You may have done problems with a title company when you refinance or sell, but she legally does not own an interest in the house now.
