You asked: After a divorce is final and all property lien''s have been paid in full to my ex-wife and her lawyer, how do I get her lawyer to discharge the liens on my property. Divorce was final in 2004 and I didn''t realize that there was still a lien on my property till I tried to refinance. My ex-wife''s lawyer will not return calls from either of us. Now what? I would suggest that you write a letter to the lawyer explaining the situation, and requesting that he removed the liens immediately and send you confirmation.  If he fails to do so, then you may have to hire a lawyer to get this done. Bigamy is when a person is married to two people at the same time. From the facts which you have disclosed does not appear that this was the case. At least in Michigan, there is no such thing as a common law marriage and there must be a marriage ceremony before a proper official at the return of the marriage license to the city and state for a marriage to be recognized legally. I am not certain that I fully understand the reason for your questions, but you are welcome to call my office for an appointment and provide further details.

You can certainly ask you to do just about anything, whether or not he can prevail is a different matter. The divorce court will look at the individual situation and attempt to fashion a fair and reasonable result if you do not agree between yourselves. Please realize, even given the shortness of the marriage, it can be shown that the improvements increase the value of the house during the course of the marriage he will be able to claim half of the appreciation.
