How do I get a divorce from someone who has been deported?

default-avatar
Answered by attorney Michael V. Fancher (Unclaimed Profile)
Divorce lawyer at Seattle Divorce Services
Under Washington law the main complication will probably be getting that person served with the initial divorce documents. If you still know where they are, you should be able to arrange service there. If you are not able to locate them, you should be able to get the court's permission to serve them either by publication or by mailing to their last know address. Consult with an attorney in your area for more information.

Been married for 18 years brought a house with his parents and now getting a divorce. mother, dad and husband name on the deed but it does say son

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
you will need to have proof of payment of the mortgage, and what you paid to purchase the property.  the way the deed is set up, it might be questionable your share or interest in the property.  Is this the house you lived in while married?  you will be able to get some interest in the property back, and it might be credited against other things owed.  Good luck.

Can I get an annulment

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Thank you for your question. I understand how worried you must be about your family matter. The short answer is possibly. Grounds for a New Jersey annulment are: Bigamy, Duress, Nonage, Incapacity, Impotence, Incest, or Fraud. An example of fraud is that one spouse is an immigrant and uses the other spouse to stay in the country. I understand that you need answers and need to protect yourself. I strongly suggest that you schedule a consultation with a family law attorney who has experience with immigration as soon as possible, so that you can understand the implications for you and your spouse.
