Ideally, your share of interest in the construction company would have been paid to you before the divorce is final in a settlement for what the company's worth was at the time of the divorce. At this point, you may be able to file a suit to enforce to receive 1% of the sale of the company, but you only have 2 years from the date of your divorce to bring this kind of lawsuit. I highly recommend investing in a consultation with a local attorney to find out your options in this case.

If your current living situation is not detrimental to the well being of your children I would think your ex would have a difficult time in modifying the judgment. However, if your ex has some evidence of conduct that is not in the minor children's best interest, such as domestic violence, drugs or alcohol, (this list is not exhaustive) then there may be grounds for a modification. I would suggest you contact an attorney to discuss your situation in detail.

In Texas, your income is community property. Even if you put it in a different account, it is still community property. All courts allow you to get a temporary restraining order that would prevent either of you from emptying any account once the case is filed. Does your wife work? Her income is considered community property as well.
