Am I eligible for my husband's pension?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
There are too many variables to give you a definite answer to your question. You should take the following steps: 1) read the decree concerning the division of property, if the order allocated a portion of the pension to you, then you should be entitled to that part of the pension, 2) if the decree awarded all of the pension to him, you are not entitled to any of it, 3) if there is no mention of the pension or retirement benefits in the decree, you may or may not be entitled to it based upon when and how the benefits were acquired, 4) contact the plan administrator to ask if you were named as the beneficiary of the plan or the plan provided for survivor benefits or whether some distribution of the benefits has already been made. I suggest you hire a lawyer.

Can we have a mutual divorce without help from an attorney?

Answered by attorney Karen A. Clark (Unclaimed Profile)
Divorce lawyer at Law Offices of Karen A. Clark
A lawyer is not required in order to file for and obtain a divorce. People usually use lawyers when communication has broken down. If you and your spouse agree to end your marriage, and believe that you have reached a fair and equitable division of the property, then you can file the required paperwork with the court. Please note that there is a statutory period of time that you must wait before the divorce becomes final. If there is property or there are children, it might be a good idea to briefly consult with an attorney to make sure that the the property division, child support, etc. is fair and that it meets the requirements.

If my daughter signed a lease agreement and is filing for divorce does she need to submit a formal eviction notice to her spouse to move him out

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
Since they are married, your daughter should get a temporary order with a move-out date for the husband. In eviction court, he could just say he's her husband and the judge won't have jurisdiction to evict him. This is a family law matter that should be handled in family court.
