Nebraska is a community property state and thus, it does not matter whose name the home is titled in - if it was purchased during the marriage and paid down with marital monies, it is a marital asset to be divided in your divorce. First, go into the state bar website and look him up. If he moved, his new address will be listed. If you still can't find him, file a request for order with the court and request that he be removed from the case and that you proceed in pro per. If you get a lawyer, then the lawyer handles it.

There is nothing unusual about a three month wait - in some counties it's much more. However, moving on cruel/inhumane was not necessarily a great idea - and if there are errors in your papers that will delay the process for quite some time.
