You are married and the reasons for annulment probably don't apply, so divorce is more likely. She will be entitle to one-half of the community property, but there may not be much of that after only two months. However, you want to be divorced as soon as possible so that her debts don't become your debts and vice versa.

Anything that is acquired by either of you during the marriage is considered "marital property" which would be subject to equitable division.  Anything that you owned prior to the marriage or anything you might have inherited during the marriage would be considered "separate property" which she could not attach.

Unless the petition was filed 3 years ago, it will not be dismissed in 22 days. If you have attempted to serve without success (and if he sees the kids, then have him served then), then service by publication is possible.
