Does your insurance cover your ex wife's pregnancy by another man?

Answered by attorney John Joseph Stanton (Unclaimed Profile)
Divorce lawyer at The Law Office of John J. Stanton
How are you able to continue to provide health insurance for your Ex if you are now divorced? Do you pay for a separate policy for her? Almost all employer-provided health insurance policies do not allow Ex-wives to be covered on a family policy. Thus, if you are divorced, you need to determine if your provider allows her on the policy, and if not, you must remove her or you could face financial repayment to your insurer. If you can keep her on the policy, then the pregnancy should be covered.

What else can I do if she tells me that she will never give me a divorce because she will lose my benefits?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
You can still file for divorce, regardless of whether she will continue to be eligible for any of your benefits. Divorce can raise some complicated issues, and you don't indicate how long you've been married, whether you have any minor children together, own real estate together, or what benefits she is specifically concerned about losing. Consult with an attorney to discuss the specifics of your situation, and your options.

For filing for a separation or divorce in US , do we both parties need to live and have residence in the states ?

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
In order to file for divorce in Florida, one of the parties has to have lived in Florida for at least  six months prior to filing the petition for dissolution.  So, if you have been here for six months the court has jurisdiction.  You do not mention whether this divorce will be amicable or not.  If you are in agreement to most issues, you could be divorced in two months.  You also do not state how long you need to be back in Europe to renew your visas.  If it is for a short period of time, it should not effect your ability to continue the divorce here upon your return.         As an aside, we do not have legal separation in Florida, so that option is not available to you.          Best of luck,       Cindy S. Vova
