Would I need an annulment or a divorce

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
Texas Family Code Sections 6.012 through 6.111 give the grounds for an annulment. It doesn't sound like your case fits under that law based on the information you've provided. However, you could get an uncontested divorce if you both agree.

Because they have been gone for over 6 months, you would probably have to go to Missouri to file a petition with the court to at least get a visitation schedule with your son. It is unclear whether you want a divorce or not, but you certainly could get an order giving you a schedule to see your son. You might want to consider moving wherever your son is to make it easier for him to see you both frequently.

What can I do if my ex wife is renting out our home that is my name?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
See an attorney. It's unclear what your divorce terms said about the house. If the house was awarded to you in the divorce, see a real estate attorney to get the tenant out. But you need to see what the lease says. If it's not her house, she shouldn't have been able to rent it out unless there's a provision in the divorce docs. Opinion not legal advice.
